• While the United States must bring its counterterrorism policies into line with domestic legal requirements, the real strategic gain will come from the development of new international legal frameworks.

• The United States should sponsor the development of a legal regime to formalize rules for dealing with “unlawful combatants.”

• The United States should promote a review of the law of “ungoverned spaces” to clarify the obligations of states to exercise effective sovereignty over their territory and the rights of states to respond if they fail to do so.
